Minors, Sex = Unjust Punishment

Honestly, I know I’ve written about this a couple times this past week but I think I did it to express how I feel about how unjust the government and laws are; in this case, about consensual sex and, what I feel, is wrongful convictions.

Please feel free to read my previous entries ‘Sex and Teens: The Law is Hypocritical’ and ‘Sex, Teens and ‘The Law’: Update’.

Genarlow Wilson served unjust punishmentBut a young man, Genarlow Wilson, was finally released from prison by the Georgia Supreme Court in a 4-3 ruling because they felt his sentence was ‘cruel and unusual.’

Wilson, who spent the last two years in jail for having oral sex with a consenting 15-year-old girl when he was 17, was originally sentenced to a 10 years, which was mandatory under the law at the time.

10 years?! For having consensual sex with someone two years younger than you?! And both were under the age of 18 at the time?! That is definitely unfair!

To make matters worse for Wilson, those Georgia laws have now been changed to “punishable by no more than a year in prison and no sex offender registration” but the law was passed after he was convicted so those changes were not retroactive and did not apply to him.

I know I’m leaving out some details which may or may not change some peoples mind, but I’m just discussing this ‘statutory rape’ law for ‘consensual sex’ just does not make sense to me. Again, please read ‘Sex and Teens: The Law is Hypocritical’ and ‘Sex, Teens and ‘The Law’: Update’ on additional information on it.

Let me just add, if the roles were reversed and say the young lady was 17 and the guy was 15-years-old and they had consensual sex, would the woman be sentenced in any cases? I have not read any particular cases similar yet, but if you guys have heard of that, please let me know.

Can you tell that I’m not a big fan of the government and laws enforced? Well, because we are all hypocrites and that’s the world we live in.

Like I have been told many times, “life is just not fair.”

And it is true.
